產業道路車禍問題

在這想先請教大大們，此事件已有報警寫筆錄完，小弟本人於上個月中騎乘機車從雙線車道騎入產業道路(轉入產業道路是N型連續小轉彎)該轉彎處只有反光片無反射鏡，當我N轉彎後有發現我車剛好在車道中間(轉後此時我已往右行駛)，我怕我後方有同向車看一下照後鏡沒車，然後我就視線往前看，看到對向車駕駛座正好在我面前約三米(汽車有超越路的中間)，我馬上又往右一閃還是來不及與汽車發生擦撞(擦撞駕駛座門)，因而摔車。

摔車後，那車主下車就在那鬼叫我說我是在打盹，我不理會他，我的左手小拇指一公分的開放性傷口及甲床整個淤血，左臂及左腳都擦傷。

上週假日對方約我去談，也沒談到什麼重點，我順便有問有沒有保第三責任險，現在確定雙方都沒有的情況是要如何處理呢?

目前我再等報告出來再來打算如何處理，對方是業務司機又於上班時段，假設最後無法和解，那要以過失傷害還是業務過失傷害罪提告呢?

像這樣情況的責任歸屬是怎麼判別?
