馬英九總統昨日親上火線，針對立法院長王金平涉嫌關說案發表聲明，前行政院發言人胡幼偉今（9）日對總統維護司法獨立與尊嚴的決心表達完全支持的立場，但胡幼偉也質疑，「馬總統的一番沈痛聲明，卻像是已為本案做出終極裁判」，那後續要召開的國民黨考紀會，立法院的紀律委員會和行政院、監察院等調查程序，還要不要進行？
在程序上，胡幼偉有所疑問，他指出，根據特偵組的結論，該案相關涉案人還要分別交由監察院、行政院及立法院審議其行為是否的確涉及關說檢察官，使其做出不起訴柯建銘之決定。國民黨考紀會也還要開會決定王院長是否違反黨紀。也就是說，後面還有一些具審判性質的程序要走。
「但馬總統的一番沈痛聲明，卻像是已為本案做出終極裁判。那剛才講的這些後續程序還要不要走呢？」胡幼偉表示，萬一，只是說萬一，監察院約談曾勇夫、陳守煌及林秀濤檢察官後，合議的結果是曾勇夫並未直接或間接要求林秀濤不再起訴柯建銘，那怎麼辦？而關於陳守煌的獨立評鑑，萬一也認定陳並未要求林檢不起訴柯呢？
他還說，又萬一，只是說萬一，立法院的紀律委員會調查結果是，王金平並未明確要求曾勇夫指示下屬檢察官不起訴柯建銘，與柯之電話內容，只是政治上的一般敷衍與客套應酬語，那又怎麼辦？「而馬主席已為本案定了調，那考紀會還能做出獨立判斷，跟主席有不盡相同的結論嗎？」
所以，胡幼偉認為，馬總統可以再三重申對維護司法獨立的立場與決心，但與過去一樣，不對個案發表個人判斷，以免影響後續調查程序的裁判結果。「畢竟，你不能說，此事已再明白不過，監察院等不必再議了！」 (接下一頁)
